Gated communities, access control, office parks, hotel security – who decides what personal information is required, where it’s stored and whether it’s a violation of the PoPI Act?

The Protection of Personal Information (PoPI) Act applies to everyone, whether they’re a public or private body. There are exclusions, but unless an institution falls within those exclusions, the PoPI Act demands compliance and accountability. Office parks, gated estates, access control points in banks and hotels – their collection of personal information and data must adhere to the letter of the law. The problem is that the letter of the law and the actions at checkpoints don’t seem to be entirely in sync.
Advocate Pansy Tlakula, chairperson of the South African Information Regulator, believes that these checkpoints are taking too much information.
